This Liability Waiver, Release, and Assumption of Risk ('Agreement') is entered into by the undersigned ('Participant') in favor of Ecstatic Living FL, its officers, directors, employees, volunteers, agents, and the Venue (collectively, the 'Released Parties').
1. ASSUMPTION OF RISK
Participant understands that participating in events and activities organized by Ecstatic Living FL involves certain risks, including but not limited to physical activity, exposure to outdoor elements (extreme heat, rain, and wind), and interaction with other participants and equipment. Participant voluntarily assumes all risks, known and unknown, associated with the Event.
2. RELEASE AND WAIVER
Participant hereby releases, waives, and forever discharges the Released Parties from any and all liability, claims, or demands for personal injury, death, property damage, or loss of any kind arising out of or related to the Participant’s presence at or participation in the Event, whether caused by the negligence of the Released Parties or otherwise.
3. INDEMNIFICATION
Participant agrees to indemnify and hold the Released Parties harmless from any and all third-party claims, losses, liabilities, damages, and costs (including reasonable attorneys' fees) arising out of the Participant's actions or conduct during the Event.
4. MEDIA RELEASE
Participant understands that photos and video may be taken during the Event. Participant hereby grants Ecstatic Living FL the right to use Participant’s likeness in promotional materials, social media, and advertising.
5. GOVERNING LAW
This Agreement shall be governed by the laws of the State of Florida. If any part of this Agreement is found to be invalid, the remainder shall remain in full force and effect.
